Acceptance of Terms
Recs' is operated by Jordan Jez, an individual ("we", "our", or "us"). By using the Recs' app or services, you agree to these Terms of Use.
If you do not agree with these terms, please do not use the app.
Use of the Service
Recs' provides a platform for users to share and discover recommendations.
You agree to use the app responsibly and not to:
- Violate any laws
- Harass or harm other users
- Upload unlawful or harmful content
- Attempt to interfere with the service or its infrastructure
We reserve the right to suspend accounts that violate these terms.
User Content
Users may submit recommendations, comments, and other content.
By submitting content you grant Recs' permission to display and distribute that content within the app.
You remain responsible for the content you share.
Subscriptions & Payments
Recs' offers a free tier with limited usage and an optional paid subscription called Recs' Premium.
Free Tier. All users can access core features with the following limits: 3 trips, 25 Recs', 20 passport stamps, and 3 guides. Recs' and guides received from other users do not count towards these limits.
Recs' Premium. Premium removes all usage limits and provides early access to new features. Premium is available as a monthly or annual auto-renewing subscription.
Billing. Subscriptions are billed through your Apple ID account. Payment is charged at confirmation of purchase. Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
Managing & Cancelling. You can manage or cancel your subscription at any time through your device's Settings → Apple ID → Subscriptions, or through the Manage Subscription option in the app. Cancellation takes effect at the end of the current billing period — you will retain Premium access until then.
Price Changes. We may change subscription pricing from time to time. Price changes will not affect your current billing period. You will be notified of any price changes in advance and given the opportunity to cancel before the new price takes effect.
Refunds. All purchases are processed by Apple. Refund requests must be made through Apple's support at reportaproblem.apple.com.
Availability of the Service
We strive to keep the app available and reliable, but we cannot guarantee uninterrupted service.
Features may change over time as we improve the product.
Account Termination
We may suspend or terminate accounts that violate these terms.
Users may delete their account at any time.
Disclaimer of Warranties
The Recs' app and all related services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the app will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any content, recommendations, or information provided through the app — including user-generated content and third-party recommendations.
Any recommendations, travel suggestions, or other content shared through Recs' are provided by individual users and do not constitute professional advice. You use all information and recommendations at your own risk.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Recs', its owner, operators, affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with:
- Your use of or inability to use the app or any related service
- Any content, recommendations, or information obtained through the app
- Any actions taken based on recommendations or content shared by other users
- Unauthorized access to or alteration of your data or transmissions
- Any third-party conduct or content on the app
- Any other matter relating to the app or these terms
In no event shall our total aggregate liability to you for all claims arising out of or relating to the use of the app exceed the amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or ten dollars ($10.00), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Recs', its owner, operators, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your access to or use of the app
- Your violation of these Terms of Use
- Your violation of any third-party rights, including intellectual property or privacy rights
- Any content you submit, post, or share through the app
- Any damage or harm caused to a third party as a result of your use of the app
Assumption of Risk
You acknowledge that travel and related activities carry inherent risks. Recs' is a platform for sharing user-generated recommendations and does not verify, endorse, or guarantee the safety, quality, legality, or suitability of any recommendation, venue, establishment, activity, or destination shared through the app.
By using the app, you expressly assume all risks associated with relying on any recommendations or information obtained through Recs', including but not limited to risks related to personal safety, health, property damage, financial loss, or dissatisfaction with any recommended experience.
Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms of Use or your use of the app shall first be resolved through good-faith negotiation. If the dispute cannot be resolved informally within thirty (30) days, it shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in the State of New York, United States.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Recs' or its operators.
Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in New York for any actions not subject to arbitration.
Severability
If any provision of these Terms of Use is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Entire Agreement
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Recs' regarding your use of the app and supersede all prior agreements, understandings, and communications, whether written or oral.
Changes to Terms
We reserve the right to modify these Terms of Use at any time at our sole discretion. If we make material changes, we will notify you through the app or by other reasonable means. Your continued use of the app after any such changes constitutes your acceptance of the revised terms. If you do not agree to the updated terms, you must stop using the app.
